All content on this website (vivamaria or “Site”) — including photographs, artwork, writing, designs, text, graphics, logos, audio, video, and site code — is owned or licensed by Viva Maria ("I", "me", "my") and is protected by U.S. and international copyright, trademark, and other intellectual property laws, unless otherwise stated.

You may view, share (with attribution), and download single copies of content for your personal, non-commercial use only, provided that you do not remove any copyright, trademark, or other proprietary notices and you do not alter the work.

Commercial use, reproduction, distribution, public display, resale, modification, or creation of derivative works from my content requires a separate written license. To request a license, contact me with details of the intended use (medium, territory, duration, audience size, and any edits). Licensing fees and terms will be provided in writing.


5. Commissioned work and transfers

Unless a written agreement states otherwise, commissioning or purchasing a print or product does not transfer copyright. Copyright ownership, rights, and any permitted uses will be governed by the written contract between the parties.


6. Required attribution

When you publish or display my content publicly and a credit is reasonably practicable, please credit: “Photo/Artwork/Writing by Viva Maria” (or other agreed credit). Specific credit requirements may be set out in licensing agreements.


7. Prohibited uses

Without prior written permission you may not:

- Use content for commercial advertising, merchandising, or promotional purposes.

- Sell, sublicense, or otherwise distribute my works.

- Remove or alter copyright, watermark, or other proprietary notices.

- Create and distribute derivative works beyond permitted use.


8. Reporting infringement (DMCA takedown procedure)

If you believe your copyrighted work has been used on the Site in a way that constitutes copyright infringement, please provide a written notice containing the following information:

a. A physical or electronic signature of the copyright owner or authorized agent.  

b. Identification of the copyrighted work claimed to have been infringed.  

c. Identification of the material claimed to be infringing and its location on the Site (URL or sufficient description).  

d. Your name, address, telephone number, and email address.  

e. A statement that you have a good-faith belief that use of the material is not authorized by the copyright owner, its agent, or the law.  

f. A statement, under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on behalf of the owner.

Upon receipt of a compliant notice I will expeditiously remove or disable access to the allegedly infringing material. If you are the uploader/creator and believe material was removed in error, you may submit a counter-notice containing:

- Your physical or electronic signature;  

- Identification of the removed material and its location before removal;  

- A statement under penalty of perjury that you have a good-faith belief the material was removed by mistake or misidentification;  

- Your name, address, telephone number, and email, and consent to jurisdiction of the federal district court in which your address is located (or, if outside the U.S., an equivalent statement) and acceptance of service of process from the party who provided the DMCA notice.


If a valid counter-notice is received, I may restore the material in accordance with applicable law.


9. Enforcement and remedies

I enforce my intellectual property rights. Unauthorized use may result in civil and criminal penalties. I reserve the right to pursue all available legal and equitable remedies.

I may update this Copyright Notice & Policy at any time. The effective date at the top will reflect the most recent revision.
